ADR Training Ontario

Colm Brannigan has been an educator in law and ADR for over 25 years at several Ontario Colleges and as an adjunct faculty member in the Faculty of Law at Queen’s University in Kingston, Ontario.

To provide innovative, cost-effective training based on best practices, Colm Brannigan is working with Richard Moore, a mediator and arbitrator who is an acknowledged leader in ADR training and Marc Bhalla, a well-known mediator and arbitrator to provide a menu of comprehensive ADR training programs including:

Conflict Management and Mediation Training

Provided with Richard Moore, these intensive workshops are highly regarded and approved towards the Qualified Mediator (Q. Med.) and the Chartered Mediator (C. Med.) designations of the ADR Institute of Canada.

Both the foundational and advanced level mediation courses would be of interest to people wanting to become a mediator on a full-time basis, and to those whose interests in mediation dovetail with other professional services.

Arbitration Training

Provided with Richard Moore and Marc Bhalla. The goal of this 5-day workshop is to give you a solid theoretical understanding of arbitration and med-arb, and ample time to interactively develop the practical skills to confidently design and conduct, efficient, effective, and fair arbitration hearings and meet the goal of producing an enforceable Arbitration Award.

Topics covered include:

  • Conflict management theory and principles
  • Principles of natural justice
  • Law and evidence
  • How arbitration fits into the conflict management spectrum and when its use is appropriate
  • How to avoid common pitfalls, the applicable rules of procedure
  • Codes of conduct
  • Ethical decision-making
  • Writing well-reasoned enforceable decisions in plain English

This 40-hour core program is offered in two segments, a three-day arbitration focused overview combined with a two-day med-arb focus which builds on and integrates with the first section to provide a unique dynamic overview of arbitration.

Med-Arb Training

Provided with Richard Moore. This course, which is one of only two med-arb workshops in Canada, is an industry leader in recognizing med-arb as an innovative stand-alone process that can be used in a range of disputes. Both Colm Brannigan and Richard Moore hold the Chartered Med-Arb designation from the ADR Institute of Canada.

The goal of this three-day med-arb training workshop is to provide a solid theoretical understanding of arbitration and med-arb, and ample time to interactively develop the practical skills to confidently design and conduct, efficient, effective, and fair arbitration, and med-arb hearings.

Topics covered include:

  • conflict management theory and principles
  • principles of natural justice; law and evidence
  • how med-arb fits into the conflict management spectrum and when its use is appropriate
  • drafting the Med-Arb Agreement
  • Med-Arb phases
  • the transitions in med-arb
  • avoiding common pitfalls

This workshop is an approved course for the Chartered Med-Arb designation of the ADR Institute of Canada.

Online Dispute Resolution (ODR) Training

Designed and provided with Marc Bhalla this course is the only one of its kind in Canada.

Now, more than ever, ADR practitioners must embrace technology in their practices. If designed and conducted appropriately, online dispute resolution is client-centric, fair, and effective. If not, it can lead to confusion, frustration, and on-going dissatisfaction.

While there are a variety of online platforms available, this workshop, delivered by Colm Brannigan, a highly experienced dispute resolution professional and an acknowledged pioneer in ODR for many years, and Marc Bhalla, is a condensed practical overview of the technology, knowledge and competencies required to run a fair, effective and online process using the Zoom platform.

This workshop will help you understand ODR from a user’s perspective and encourage reflection on how it can be incorporated into your existing ADR practice.

The workshop will be of interest to all dispute resolution practitioners as ODR can be used in mediation, med-arb, and arbitration and in a wide variety of subject matter disputes.

This is an opportunity to see how to apply your conflict management and dispute resolution skills in a specific online environment and consider how ODR may be able to help you re-tool and enhance your existing practices.
